Digital Files Terms of Use

By purchasing and downloading digital files from MilkMilkSugar, you agree to the following terms of use:

• USAGE OF FILES

  • The digital files purchased from MilkMilkSugar are intended solely for use on physical merchandise that you intend to sell (B2C). This includes items such as clothing, accessories, home decor, and more. You are able to sell that merchandise unlimited number of times.

  • Personal use for any application.

  • Use a POD (Printful & Printify) service to sell your products.
    
    *Applies to micro businesses as defined by STATCAN.GC. (Fewer than 10 employees) and less than $250,000 net income per year.
     

• PROHIBITED USES

  • You are strictly prohibited from re-selling, distributing, or sharing the digital files in any digital format. This includes selling the files as digital downloads, sharing them for free, or distributing them on any online platform.

  • The files cannot be sold or used to create products such as transfers, stickers, or similar items for resale in a B2B fashion unless specifically licensed. You can be an exclusive licensed printer by joining the Liquid Sugar tier here. Please familiarize yourself with the Liquid Sugar tier terms of use at the bottom of this page.
     

• EDITING AND MODIFICATIONS

  • You have the right to edit and modify the purchased digital files to suit your needs. This includes resizing, reshaping, or altering any part of the design. However, such modifications do not transfer ownership or copyright of the original design.
     

• OWNERSHIP AND COPYRIGHT

  • Any designs that include elements from MilkMilkSugar remain the intellectual property of MilkMilkSugar. You do not acquire ownership rights or copyright to any part of the design, even if modified.
     

• SOCIAL MEDIA CREDITING

  • When showcasing items for sale that have been created using MilkMilkSugar designs on social media platforms, you are required to tag @milkmilksugarr in your posts.
     

• THIRD PARTY USE

  • You may not share, sell, or transfer the digital files to any third party for their use. Each purchaser is responsible for adhering to these terms.
     

• MODIFICATION OF TERMS

  • MilkMilkSugar reserves the right to modify or update these terms of use at any time. It is your responsibility to review the terms periodically to ensure compliance.

  • I am not responsible for end-use of products in terms of legal compliance.

  • Legal jurisdiction as per my residence/business registration.

By purchasing and downloading our digital files, you acknowledge and agree to abide by these terms of use. Failure to comply with these terms may result in legal action.

Terms of Use for the 'Liquid Sugar' Patreon Tier of MilkMilkSugar

This document outlines the binding terms and conditions attached to the 'Liquid Sugar' Patreon Tier offered by MilkMilkSugar. By subscribing to this tier, the subscriber (hereinafter referred to as “Licensee”) agrees to the following terms:

• GRANT OF LICENSE

  • MilkMilkSugar hereby grants the Licensee a non-exclusive, non-transferable license to utilize specific digital files provided by MilkMilkSugar solely for the purpose of printing UVDTF or heat press transfers for business-to-business (B2B) sales.
     

• PRODUCTION RESTRICTIONS

  • ​All production activities utilizing the digital files must be conducted in-house. Engaging third-party entities for the purpose of printing or production is expressly prohibited.
     

• FILE DISTRIBUTION

  • The digital files provided are proprietary and confidential. The Licensee is strictly prohibited from sharing, distributing, or otherwise making these files available to any third parties, including customers to whom the printed transfers are sold.

• QUALITY ASSURANCE

  • The Licensee is obligated to maintain a standard of quality in the production of transfers that reflects positively on the MilkMilkSugar brand. Substandard production quality is grounds for immediate termination of this license.

• INTELLECTUAL PROPERTY

  • The Licensee acknowledges that all intellectual property rights in the digital files remain the sole property of MilkMilkSugar. No transfer of intellectual property rights is made under this agreement.

• LAW COMPLIANCE

  • The Licensee shall ensure full compliance with all applicable local, state, national, and international laws and regulations in the use of the digital files and the sale of the printed transfers.

​

• NO RESALE OF DIGITAL CONTENT

  • The resale, redistribution, or any form of transfer of the digital files to third parties is strictly prohibited.

• TERMINATION

  • In the event of a breach of any of these terms, MilkMilkSugar reserves the right to immediately terminate this license. Upon termination, the Licensee must cease all use of the digital files and discontinue the sale of any printed transfers derived from them.

​

• SUBSCRIPTION CANCELLATION

  • The Licensee’s rights under these terms are contingent upon an active subscription to the 'Liquid Sugar' tier. In the event of subscription cancellation, the Licensee must immediately cease the sale of all transfers printed using the digital files. Any remaining inventory of such transfers must be disposed of or held until the subscription is renewed.

By subscribing to the 'Liquid Sugar' Patreon Tier, the Licensee expressly agrees to these terms. This agreement constitutes the entire understanding between MilkMilkSugar and the Licensee regarding the 'Liquid Sugar' Patreon Tier.
